These Terms of Service ("Terms") govern your use of the kivumoney.com website and, once launched, the Kivu money transfer service (together, the "Service"), operated by Kivu Money Services LLC, a Florida limited liability company ("Kivu," "we," "us"). By using the Service, you agree to these Terms.
Kivu Money Services LLC is registered with the U.S. Department of the Treasury's Financial Crimes Enforcement Network (FinCEN) as a Money Services Business. Kivu provides international money transfer services from the United States (and, when launched, Canada) to recipients in Rwanda, delivered via mobile money or bank transfer. Payment collection, foreign exchange, and disbursement are performed with licensed and regulated financial partners.
The Service is currently in a pre-launch phase. The website provides information, live rate comparisons, and a waitlist. Money transfer functionality becomes available at launch, subject to eligibility and identity verification. Sections of these Terms describing transfers apply from the moment transfer functionality is offered to you.
Kivu's pricing is a single disclosed exchange-rate spread. Our customer rate is the National Bank of Rwanda (BNR) reference selling rate reduced by a disclosed percentage, currently 0.99%, and that distance is your entire cost. There is no transfer fee. The BNR reference rate and the Kivu rate are shown side by side, the exact amount your recipient receives is shown before you confirm, and the rate is held for 30 minutes from quotation. If the disclosed spread changes, the change will be announced and displayed before it applies to you, never applied silently. The full commitment, including the announcement procedure that governs any change to the disclosed spread, is set out in our Pricing Policy, which is part of these Terms.
Your cancellation, refund, and error-resolution rights are described in our Transfer Policy, which is part of these Terms. In summary: you may cancel a transfer within 30 minutes of payment for a full refund (provided the funds have not yet been picked up or deposited), and you may report errors within 180 days of the promised availability date.
You may not use the Service for any unlawful purpose, including money laundering, terrorist financing, fraud, or sending funds on behalf of undisclosed third parties; to evade sanctions or export controls; or in violation of any applicable law. We screen customers and recipients against applicable sanctions lists and may block, suspend, or report transactions as required by law.
Kivu operates an anti-money laundering and sanctions compliance program. We may request additional information about you, your source of funds, or your transfers at any time, and may delay or decline transactions until such requests are satisfied. Where required by law, we file reports with regulatory authorities without notice to you.
The Kivu name, logo, website, and app are the property of Kivu Money Services LLC. You may not copy, modify, or distribute them without our written permission.
The Service is provided "as is." To the maximum extent permitted by law, Kivu disclaims implied warranties and is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits rights you hold under applicable consumer protection law, including the federal Remittance Transfer Rule, or limits our liability for fraud or willful misconduct. Our total liability in connection with any transfer will not exceed the amount of that transfer plus fees paid.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before pursuing formal action, contact us at info@kivumoney.com — most issues are resolved directly. Nothing in this section waives rights or remedies available to you under federal or state consumer financial protection law.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and, where required, notified to you directly. Continued use of the Service after changes take effect constitutes acceptance.
